NationsHearing, LLC, NationsBenefits, LLC, and subsidiaries and affiliates (collectively, “the Company”, “NationsHearing”, "us," "our," or "we") strives to offer vistors of our Hearing Hunt mobile application (the “app”, “service”) the many advantages of internet technology and to provide an interactive and personalized experience. In this Privacy Policy (the “Policy”), we describe how we collect, use, and disclose information that we obtain about visitors to the app. By using the app, you agree to the terms of this Policy.

Your use of our app and any dispute over privacy, is subject to this Policy and our Terms and Conditions, including its applicable limitations on damages and the resolution of disputes. Our Terms and Conditions are incorporated by reference into this Policy. To the extent that information collected through the app is Protected Health Information (“PHI”) as defined by the Health Insurance Portability and Accountability Act (“HIPAA”), this information is governed by HIPAA.

INFORMATION COLLECTION.

This Policy tells you, among other things, what information we gather from you through our app, how we may use or disclose that information, and our efforts to protect it. We may collect information about you directly from you and from third parties, as well as automatically through your use of our app and services.

WHO MAY USE THE SERVICES.

This app is neither intended for nor designed to attract minors. We do not knowingly collect personal information online from any person we know to be under the age of 13 and instruct users under 13 not to send us any information to or through our online services. Any Personal Information of a child under 13 that is provided to us must be provided by a parent or legal guardian, and not by a child under the age of 13 who is using the app. If you are the parent or legal guardian of a child under the age of 13 whom you have reason to believe provided his or her own Personal Information to us, you have the right to review and request the removal of that child’s Personal Information from our database. In order to request such removal, please contact us.

The app is designed for users from, and are controlled and operated by us from, the United States. By using the app, you consent to the transfer of your information to the United States or storage of your information in the United States, which may have different data protection rules than those of your country.

PERSONAL INFORMATION WE COLLECT.

We want you to understand how personal information you provide to us is collected and used. Personal Information is any information that we can use to identify, locate, or contact you. We may collect and store your personal information when you provide it to us. Some examples of personal information we collect and when we collect it include:

• When you sign in to the app or register on the app
• When you supply your ID card number
• When you supply your personal information, including but not limited to, email address, date of birth, id number, address, phone number, full name, etc.
• Your interactions with our website, app, Wi-Fi, and other online services
• How you use our app, search terms, pages you visit on our app, computer and mobile device information and push notification services you request
• General location information from your browser or device, which we use for internal purposes only

If you choose not to provide your personal information to us, we may not be able to provide you with requested products, services or information.

If you submit any personal information relating to other people in connection with the app, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

We may combine the information collected from you through the app with information we receive from and about you from other online and offline sources and use the combined information in accordance with this Privacy Policy. Our goal is to offer you content, advertisements, information, products, and services that are most likely to appeal to you.

HOW WE USE YOUR INFORMATION.

We use your information, including your personal information to respond to your requests, contact you with information, send you information and marketing communications and to provide you with related customer service. Manage services, including outcomes management, and offer other products and services that may be of interest to you.

We may use your personal information to personalize your experience and interacting with us, including by presenting products, offers, and content tailored to you, and for our business purposes, such as data analysis, outcomes, audits, fraud monitoring and prevention, developing our services and new products and services, determining the effectiveness of our promotional campaigns and content, and operating and expanding our business activities.

We may disclose personal information to our service providers, who provide services such as webapp hosting, data analysis, information technology and related infrastructure provision, customer service, email delivery, auditing, and other services.

If we are requested by law enforcement officials or judicial authorities to provide personal information, we may do so. In matters involving claims of personal or public safety or in litigation where the information is pertinent (including to allow us to pursue available remedies or limit the damages that we may sustain), we may use or disclose personal information, including without court process. We may also use or disclose personal information to enforce our terms and conditions, to protect our operations or those of any of our affiliates, or to protect our rights, privacy, safety or property and/or that of our affiliates, you, or others.

We may use and disclose personal information to investigate security breaches or otherwise cooperate with authorities pursuant to a legal matter.

We may use and disclose information that does not personally identify you for any purpose, except to the extent limited by applicable law. If we are required to treat such information as personal information under applicable law, then we may use it for all the purposes for which we use and disclose personal information. We may combine information that does not personally identify you with personal information. If we do, we will treat the combined information as personal information as long as it is combined.

Though we make every effort to preserve user privacy, we may disclose personal information when required by law or under the good-faith belief that such action is necessary under applicable law. We may disclose personal information in order to establish or exercise our legal rights or defend against legal claims. We also share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, to protect our property or interests or that of our agents and employees, and to protect personal safety or the public.

INFORMATION FROM OTHER SOURCES.

We may collect data about you from publicly available sources to personalize your experience. We may also obtain data provided by third parties. For example, we may obtain information from companies to improve the accuracy of the information we have about you (e.g., adding your zip code to your address information).

YOUR RESPONSIBILITY.

By logging in or by submitting your necessary information, you agree that it is your responsibility to:

• Authorize, monitor, and control access to and use of your account and
• Promptly inform us of any need to deactivate your account.

TRACKING MECHANISMS.

We and our third-party service providers use cookies and other tracking mechanisms to track information about your use of our app or services. We may combine this information with other personal information we collect from you (and our third-party service providers may do so on our behalf).

THIRD PARTY ANALYTICS.

We use automated devices and applications, such as Google Analytics, to evaluate traffic to our app. Google Analytics is a web analysis service provided by Google that utilizes cookies to monitor and provide us with aggregate data about App traffic. We use these tools to help us improve our aervices, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services. We do not share your personal information with these third parties.

HOW YOU MAY OPT-OUT.

We are committed to your privacy rights and your privacy considerations. You have a right not to provide us with your personal information, by not submitting your personal information to the App. At any time, you may withdraw your consent that you previously gave us and must communicate this to us in writing.

Upon receipt of this communication, we will no longer contact you by phone or email. However, we may still contact you for administrative and/or transactional purposes.

YOUR CALIFORNIA PRIVACY RIGHTS.

If you are our customer and a California resident, you may request that we provide you with certain information about the entities with which we have shared our customers' personal information for direct marketing purposes during the preceding calendar year. We seek to use reasonable physical, technical, and administrative safeguards to protect personal information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account with us has been compromised), please immediately contact us.

You are responsible for maintaining the confidentiality of your app access information and personal information and for restricting access to your device, and you agree to accept responsibility for all activities that occur under access.

The app may contain links to other webapps maintained by third parties. Please be aware that we exercises no control over linked apps and is not responsible for the privacy practices or the content of such apps. Each link maintains its own independent privacy and data collection policies and procedures, and you are encouraged to view the privacy policies of these other apps before providing any personal information.

We will only provide an advance notice of a major change prior to your access of any portion of the app for which registration required or as required by law.
